By downloading, installing, or using the Breathly mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the App.
2. Description of Service
Breathly is a wellness application that provides:

- Custom breathing routines
- Session progress tracking
- Haptic and audio guidance

IMPORTANT: Breathly is a wellness tool, not a medical device. It does not provide medical advice, diagnosis, or treatment.
By using this App, you acknowledge that:
- Breathing exercises are for general wellness purposes only
- The App is not a substitute for professional medical advice or therapy
- You should consult a healthcare provider before starting any breathing practice if you have respiratory conditions, cardiovascular issues, or other health concerns
- You use the App entirely at your own risk
4. Data and Privacy
All your breathing session data, custom routines, and progress are stored locally on your device. Please refer to our Privacy Policy for complete details.
- You own all data you enter into the App
- You can delete your data at any time
- We do not have access to your personal data
5. Subscriptions
Breathly offers a premium tier ("Breathe Pro") with additional features:
- Pricing is clearly displayed before purchase
- Subscriptions auto-renew unless cancelled before the renewal date
- Refunds are subject to Apple App Store and Google Play Store policies
- You can manage or cancel your subscription through your device's app store settings
6. Intellectual Property
The Breathly app, including its design, code, features, audio content, and branding, is the intellectual property of Byte Flux Studios LTD. You may not copy, modify, distribute, or create derivative works without permission.
7. Limitation of Liability
To the maximum extent permitted by law, Byte Flux Studios LTD is not liable for:
- Any health outcomes from using or misusing the App
- Decisions made based on App content or guidance
- Data loss due to device failure or uninstallation
- Indirect, incidental, or consequential damages
The App is provided "as is" without warranties of any kind.
8. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
